    1.       These are the terms and conditions of use for the Contest (as defined hereinafter) offered by VLPCPL Wellness Private Limited on www.durexindia.com (“Contest Terms”) and form a legal and binding agreement amongst VLPCL Wellness Private Limited (“Company”,  “us”, “we” or “our”) and any person (“You”/“Your”/“User”) accessing any Contest (as defined hereinafter),  related data, information, text, graphics, video, sound, pictures, and any other materials appearing, sent, uploaded, communicated, transmitted, or otherwise made available via in connection with the Contest through the content shared by the Company on www.durexindia.com (“Platform”) for participating in various contests and Contests hosted by the Company on www.durexindia.com Platform including but not limited to Durex Lucky 69 contest being conducted by the Company from 6th February to 9th February 2025 (“Contest”).

    2.       Eligibility: You understand and acknowledge that you must be over 21 years of age and a resident of India to access and/or use our Contests. By agreeing to these Contest Terms, you represent and warrant to us that: (a) you are at least 21 years old; (b) you have not previously been suspended or blocked from accessing our Contests or otherwise from using the Platform; (c) your  access to the Contests and use of the Platform is in compliance with any and all applicable laws and regulations; and (d) you are a resident of India.

    3.       Participation: Subject to compliance with Contest Terms (including Eligibility criteria specified in Clause 2 above):

    (a)    You automatically enter the Contest upon making a single purchase of Rs. 2000/- (inclusive of taxes) or more on https://www.durexindia.com during the Durex 69 Big Bang Sale which runs from 6th to 9th February 2025.

    (b)   To submit the final entry, the customer will have to answer two questions which will be sent via Whatsapp/ through the Thank you page from the official Durex India account.

    (c)    The contest is valid for single-entry purchases only. Bulk orders are not eligible; and

    (d)   Purchase of pack of 100 and Pack of 50 Condoms will not be eligible for participation in the Contest.

     

    4.       Selection of Winners:

    (a)    Winners will be selected through a randomiser process after the 69 Big Bang Sale ends on 9th February 2025.

    (b)   A total of 70 lucky winners will be announced.

     

    5.       Prizes:

    (a)    All orders placed during the Durex 69 Big Bang Sale will receive an assured gift of a Pin badge and Free Love Vouchers eGuide PDF.

    (b)   All customers placing Orders of Rs. 2000/- and above during the sale duration will receive Durex Discount Vouchers worth Rs. 629/- for their next order

    a.       Code Validity: 3 Months

    b.       Discount coupon valid only on DurexIndia.com

    c.       Unique Vouchers valid for 1 order

    d.       Minimum order Value: Rs. 1800/-

    (c)    1 Lucky69 Contest winner will receive a Travel Voucher worth Rs. 69000/-.

    (d)   69 winners will receive Dining Vouchers worth Rs. 1690 each/-, from Zomato.[MB1] 

     

    1. Contest Duration:
      1. The contest is valid only during the Durex 69 Big Bang Sale period from 6th Feb, 12:00 AM to 9th Feb, 11:59 PM. Purchases made outside this timeframe will not be considered.

    2. Announcement of Winners:
      1. Winner Announcement shall take place on Feb 14th, 2025
      2. All the Winners of the Lucky 69 Mega Contest shall be contacted by the Company’s Consumer Grievance Manager, Sahiba Goel, via email address: hello@durexindiawos.com or Mobile no: 01414931562
      3. Winners will be notified via their registered contact details provided during the purchase, i.e. email id.
      4. the Company reserves the right to announce winners publicly on its official social media platforms and website.

     

    8.       Contacting Winners:

     

      1. The Contest Prize winners will be contacted through their registered email ids and  phone numbers attached to their order.
      2. Step 1: Once the winners are selected, the Company shall process the gift for them. The customer care team of the Company will connect with the winners.
      3. Step 2: In the event the shortlisted Bumper Prize winner's number is busy, unreachable, or he/she does not attend the call, two (2) more attempts will be made to reach the Participant on that day and/or the next business day.
      4. Step 3: If even on the third attempt, the Participant does not attend the call, or is unreachable, the Participant's participation in the Contest comes to an end and the Participant's entry stands cancelled and Participant becomes ineligible to receive the Bumper Prize of a travel voucher worth INR 69,000.
      5. Step 4: If any shortlisted Prize winner remains unreachable on the third attempt or is not interested in continuing in the Contest or is otherwise ineligible to participate, the Agency 1 shall conduct up to two (2) more random selections to shortlist a Participant, and the Bumper Prize will go the next shortlisted winner.
      6. Step 5: In case of a positive response to claim the Bumper Prize from the shortlisted winner on phone each such shortlisted winner will be required to share his/her address, within 72 hours of the first winning confirmation conveyed to the winner by Agency 2 on phone, to deliver the Bumper Prize to the winner.

     

    9. The Bumper Prize winner of INR 69,000 domestic travel voucher shall produce the following documents at the time of delivery of Bumper Prize for verification purposes.

    -          Copy of Address proof (Electricity bill or Mobile Bill)

    -          Valid government authorized document such as PAN card

    -          Mobile Number

    -          No Objection Certificate (Letter) – Self Attested

     

    If all the documents produced are in order and valid then the participant becomes eligible to be a winner and the Bumper Prize will be handed over to the winner.

     

    10.   Bumper Prize winner's name will be published on the Durex India Instagram handle, website i.e. www.durexindia.com and other physical, social and digital media platforms.

    a.       No Prizes will be awarded if the information presented by the Participant(s) at the time of entering the Contest is incorrect.

    b.       In the event of death of the confirmed Bumper Prize winner, no claim from the nominee or his/her legal heirs shall be entertained for receiving the Bumper Prize

     

    1. Conditions:
      1. Vouchers are non-transferable, non-exchangeable, and cannot be redeemed for cash.
      2. Incomplete or fraudulent transactions will not be considered for the contest.

     

    12.   Such User (as described above) shall be bound by these Contest Terms, privacy policies and all other rules, regulations, and terms of use referred to herein or provided by Company in relation to any Contests. In so far as any Contests may be provided through any Platform operated by any third parties, please note that we do not control the content that appears on such Platform. The Company does not warranty the accuracy, integrity, quality of the content provided by third parties, while participating in any of the Contests hosted on such third-party Platform. We are further not responsible for the practices employed by such third parties, including practices relating to the Users’ personal information. Browsing and interaction on any other third-party’s Platform is subject to such third parties’ own terms and policies, including policies in relation to the collection and use of your personal information. We encourage you to read the terms and policies of any third-party before proceeding to use their websites, products, or services.

     

    13.   This document is an electronic record in terms of the Information Technology Act, 2000 and rules there under as applicable and various other statutes. This electronic record is generated by a computer system and does not require any physical or digital signatures.

     

    14.   You acknowledge and agree that by using, or otherwise accessing the Platform and Contests, you agree to be bound by these Contest Terms, and undertake to be bound by the specific rules and regulations of each of the Contests as applicable.

     

    15.   The Contests may change or be modified from time to time without prior notice or communication. Company reserves the right to change, modify or delete the Contests made available on the Platform at any time.

     

    16.   Subject to the Users’ compliance with these Contest Terms, the Company gives Users a personal, royalty-free, non-assignable, non-sublicensable, non-transferable, non-exclusive, and revocable limited right to access and use the Platform, subject to the terms of any third-parties operating such Platform, that is provided as part of the Contests. This right is for the sole purpose of enabling the Users’ own personal private use in order to play Contests as hosted on the Platform, in the manner prescribed under these Contest Terms and not for any commercial purposes, in India and is valid only until the User is bound by these Contest Terms.

     

    17.   You acknowledge that your participation in any Contest available on the Platform is purely voluntary and at your sole discretion and risk. You further understand that we provide the Contests on our Platform on an ‘as is’ basis.

     

    18.   You are solely responsible for your participation in our Contests and any other actions on our Platform. The Company shall not be responsible for your actions or conduct, or content (including unlawful or objectionable content) uploaded by you on the Platform.

     

    19.   Any external charges levied on Users for participating in the Contests, including but not limited to internet connection and/or mobile or data charges are solely the responsibility of such Users.

     

    20.   The Contests may include advertisements. The types and extent of advertising by Company on the Contests are subject to change.

     

    21.   In order to access the Contests offered by the Company on its Platform, a User is required to register on the Platform by creating an account (“User Account”). In order to access the Contests offered by the Company on any third party operated Platform, a User must be registered on such Platform with their own user account. You may be able to avail of certain Contests without such registration. Your participation in such Contests will be subject these Contest Terms and you may be required to provide us with necessary personal information to enable your participation.

     

    22.   You undertake to provide true, accurate, current, and complete information to your personal knowledge at the time of registration on the Platform and at all other times (as required by Company).

     

    23.   You further undertake that you are not a minor, and we may exclude a person from participating in our Contests if the Company suspects that a person is under the age of 21 years.

     

    24.   By accepting these Contest Terms upon registration, you give consent to Company to disclose your personal information provided to us to a third-party agency to assist in verifying your identity. The third-party agency may prepare and provide Company with such an assessment and may use your personal information including the names, residential addresses and dates of birth, financial information etc. for the purposes of preparing such an assessment.

     

    25.   We only provide legally permissible free to-play-Contests on our Platform and do not accept any deposit amounts or real money from Users for availing our Contests on the Platform.

     

    26.   Users understand and acknowledge that the Contests hosted on the Platform are such Contests as may be permitted under applicable Indian laws, and that we do not support, endorse, or offer to Users any Contests which are in the nature of betting, gambling or wagering or otherwise prohibited and/or regulated under any State laws in India.

     

    27.   You agree and accept that Company shall not be liable or responsible for the breach of applicable state laws by any User. There may be applicable penalties imposed on such Users by the respective State Governments or the Central Government of India as the case may be. Such liability shall be solely on the User and Company reserves the right to suspend/terminate such User’s participation in its Contests without any notice. You agree and acknowledge that our decision in this regard will be final and binding, and no consideration, whatsoever, will be extended to the User.

     

    28.   Our Contests are available only to Users who are eligible in accordance with the clause 8 of these Contest Terms, and to only one User per user account per game. The results of their participation in any Contests will be intimated to the Users through the preferred communication mode either by message on the Platform and the Users will be informed of the means to claim their outcomes of their participation, if any, through such mode.

     

    29.   Users understand and acknowledge that the decisions of the Company in all matter relating to the Contests are final and binding, including but not limited to decisions on the outcomes of the Users’ participation in any Contests.

     

    30.   Prohibited Conduct: By participating in our Contests, you agree that you will not:

    (a)    use the Platform or any Contests in any manner which is, in our sole discretion, not reasonable and/or not for the purpose it is made available;

    (b)    violate the rights of any person, including copyright, trade secret, privacy right, or any other intellectual property or proprietary right;

    (c)    act in violation of any Contest Terms of participating in the Contests or using our Platform;

    (d)    reproduce, republish, retransmit, modify, adapt, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit our Platform or any content thereon, except as expressly authorized by us;

    (e)    use any automated launching or entry software or any other mechanical or electronic means to automatically enter in any Contests repeatedly;

    (f)     attempt to deliberately damage; or undermine the legitimate operation of the Contests by the Company;

    (g)    tamper with, or benefits from any tampering or system error with the operation of any Contests, or acts in a disruptive manner with the intent to hampers or disturbs the conduct of any Contests;

    (h)    participate in or access the Contests from outside India. Any Users doing so will be participating at their own risk and are responsible for compliance with the laws of such jurisdiction. These Contest Terms do not constitute, nor may it be used for or in connection with, any promotional activities or solicitation by anyone in any jurisdiction in which such promotional activities or solicitation is not authorized or to any person to whom it is unlawful to promote or solicit in any manner.

     

    31.   If you choose to submit any content on the Platform in the course of your participation in our Contests, you hereby warrant that no content shall:

     

      1. belong to another person and to which the user does not have any right;
      2. be defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing on the basis of gender, libelous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
      3. be harmful to children;
      4. infringe any patent, trademark, copyright or other proprietary rights;
      5. violate any law for the time being in force;
      6. deceive or mislead the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
      7. impersonate another person;
      8. threaten the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation;
      9. contain software virus or any other computer code, file or program designed to
      10. interrupt, destroy or limit the functionality of any computer resource;
      11. be patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.

     

    1. The Company may not be held responsible for any content posted or contributed by Users on the Platform.

     

    1. In the event User does not abide by these Contest Terms and all other rules, regulations, and terms of use, or is found to be engaging in any prohibited conducted Company may, at its sole and absolute discretion, take necessary remedial action, including but not limited to restricting, suspending, or terminating any User’s participation in all or any Contests;

    34.   The Contests include a combination of content created by Company, its partners, affiliates, licensors, associates and/or Users. The intellectual property rights (“Intellectual Property Rights”) in all software underlying the Contests and material published on the Platform, relating to the Contests, including but not limited to, software, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings and flash animation, is owned by Company, its affiliates, partners, licensors and/or associates. Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content of Company either in whole or in part. Nothing in these Contest Terms shall be construed to convey, and the Users by virtue of these Contest Terms shall not acquire, any ownership or other interest or right in any intellectual property any of the materials or content related to the Contests available on the Platform.

     

    1. Users are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise make available on the Platform. Each User represents and warrants that he/she owns all Intellectual Property Rights in the User’s content and that no part of the User’s content infringes any third-party rights. Users further confirm and undertake to not display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights of any third party on the Platform.

     

    1. Users hereby grant to Company and its affiliates, partners, licensors and associates a worldwide, irrevocable, perpetual, royalty-free, non-exclusive, sub-licensable, license to use, store, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish Users’ content for any purposes, including but not limited to displaying Users’ content on Platform, distributing it to other Users, etc.

     

    37.   Publicity: Users by the means of participating in the Contests on the Platform grant permission to the Company, and its affiliates to use the User’s name, likeness, voice, and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any further permissions or consents and/or additional compensation whatsoever. The User further undertakes that they will be available for promotional purposes as planned and desired by Company without any charge. Such promotional activities may include but not be limited to publications, advertisements, press events, internal meetings and ceremonies/functions.

     

    38.   Nothing in these Contest Terms shall prejudice the exercise of your statutory rights as a consumer under applicable laws.

     

    39.   The Contests and all information, content, materials, products (including software), and other services included on or otherwise made available to you through the Platform are provided by the Company on an “as is” and “as available” basis. The Company makes no representations or warranties of any kind, express or implied, including but not limited to, any warranties of merchantability and fitness for a particular purpose, as to the operation of the Contests, or the information, content, materials, products (including software), or other services included on or otherwise made available to you through the Platform. You expressly agree that your participation in the Contests is at your sole risk.

     

    40.   Without limiting the generality of the foregoing, to the maximum extent permitted by applicable law, we shall have no liability for any damages or injury caused, in whole or in part, by contingencies or issues beyond our reasonable control, including, but not limited to: the acts of third parties, errors in the Contests, or the Platform, network failures, internet failures, software and hardware failures, viruses and other system attacks, labor stoppages, riots, acts of government or god, natural disasters, acts of terrorism, communication line failure, or theft, destruction of, unauthorized access to, alteration of or use of records.

     

    41.   You agree and acknowledge that with full knowledge of the facts and circumstances surrounding the Contests hosted on the Platform, you are voluntarily participating in the Contests and assume all responsibility for it and risk resulting from your participation. Company makes no guarantees, warranties, representations, or other promises relating to the Contests and assumes no liability or responsibility for any harms, including but not limited to any financial harms, that you may sustain as a result of participation in the Contests.

     

    42.   You agree to indemnify and hold harmless the Company and its affiliates, and each of its and their officers, directors, employees, consultants, licensors, agents, and representatives from and against any and all claims, losses, damages or liability that may be asserted against or incurred by any of them at any time, in connection with entry, or participation or inability to participate in any Contests, or your breach of any agreement or warranty associated with any Contests.

     

    1. This indemnification obligation will survive the expiry or termination of these Contest Terms and your participation in the Contests.

     

    1. You agree further to indemnify and hold harmless, Company from any claim, demand, damage, or loss whatsoever coming out due to your non-compliance with the laws of your jurisdiction.

     

    45.   We may change, suspend or discontinue your access to any Contests, without notice or liability at our sole discretion, without prejudice to any legal or equitable remedies available to us, for (a) violation of these Contest Terms or other rules and regulations or guidelines posted on the Platform; (b) any unlawful conduct or conduct which we believe is harmful to other Users, to our businesses, or other information providers; or (c) any other reason as we may deem fit.

    1. You acknowledge that your representations, undertakings, and warranties and the clauses relating to indemnities, limitation of liability, grant of license, governing law and jurisdiction, shall survive the termination of these Contest Terms.

    1. Notwithstanding anything set out in these Contest Terms, the decision of the Company as to the interpretation of any clause under these Contest Terms shall be final and binding on the Users.

     

    1. Subject to the clauses below, the courts of competent jurisdiction at Delhi shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with the Contests provided by Company through the Platform (including the construction, validity, interpretation and enforceability of these Contest Terms, or the rights and obligations of the Users), as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute. All such issues and questions shall be governed and construed in accordance with the laws of India.
